Terms of Service

By accessing or using Mailor's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you are prohibited from using or accessing our services.

These Terms of Service apply to all users of the service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

Subject to your compliance with these Terms, Mailor grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our services for your personal or internal business purposes.

This license does not include:

• Any resale or commercial use of our services or content
• Any collection and use of any product listings, descriptions, or prices
• Any derivative use of our services or content
• Any downloading or copying of account information for the benefit of another party
• Any use of data mining, robots, or similar data gathering and extraction tools

To access certain features of our services, you must register for an account. When you register for an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this age requirement.

You agree not to use our services to:

• Violate any applicable laws or regulations
• Transmit any material that is unlawful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Infringe upon any patent, trademark, trade secret, copyright, or other intellectual property rights
• Transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature
• Attempt to gain unauthorized access to any portion of our services or any other systems or networks
• Engage in any activity that interferes with or disrupts our services
• Use our services for sending spam or unsolicited commercial email
• Harvest or collect email addresses or other contact information without consent

Mailor commits to maintaining 99.99% service uptime, calculated on a monthly basis. This excludes scheduled maintenance windows, which will be announced at least 48 hours in advance.

Service Credits:

• 99.0% - 99.99% uptime: 10% service credit
• 95.0% - 99.0% uptime: 25% service credit
• Below 95.0% uptime: 50% service credit

Service credits will be applied to your next billing cycle and do not constitute a refund.

Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law or as explicitly stated in these terms. All fees are exclusive of taxes, and you are responsible for all applicable taxes.

We reserve the right to change our fees upon 30 days' notice. Such notice may be provided through the service or via email to your registered email address.

If your payment method fails or your account is past due, we may suspend your access to the services until payment is received.

Your use of our services is also governed by our Privacy Policy. We implement industry-standard security measures to protect your data, including:

• End-to-end encryption for all email communications
• 256-bit AES encryption for data at rest
• TLS 1.3 for data in transit
• Regular security audits and penetration testing
• Compliance with GDPR, CCPA, and other applicable data protection regulations

The service and its original content, features, and functionality are and will remain the exclusive property of Mailor and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain all rights to the content you upload, post, or transmit through our services. By using our services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content solely for the purpose of providing our services to you.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MAILOR EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the services will be uninterrupted, secure, or error-free, that defects will be corrected, or that our services or servers are free of viruses or other harmful components.

IN NO EVENT SHALL MAILOR, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to these terms or your use of our services shall not exceed the amount you have paid us in the twelve (12) months prior to the event giving rise to the liability.

You agree to defend, indemnify, and hold harmless Mailor and its licensors, employees, contractors, agents, officers and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney's fees) arising from:

• Your use of and access to the services
• Your violation of any term of these Terms
• Your violation of any third-party right, including any copyright, property, or privacy right
• Any claim that your content caused damage to a third party

We may terminate or suspend your account and access to the services immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the services will immediately cease. If you wish to terminate your account, you may do so through your account settings or by contacting our support team.

All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute, unless you opt out of arbitration within 30 days of accepting these terms.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms.
